Italian Fable S.r.l. (hereinafter to be called “IF”) hereby informs all those using the web services on its site (hereinafter to be called the “Site”), pursuant to Article 13 of Legislative Decree no. 196 of 30 June 2003, (The Personal Data Protection Code – hereinafter to be called the “Code”), that it processes the personal data of users and their accounts in compliance with the current law on privacy.

This Informative Statement (hereinafter to be called the “Informative Statement”) has been provided for the Site alone and not for other web sites which may be visited by users by means of links to external web pages belonging to third parties.

IF will be able to amend, update or add to the Informative Statement on a periodical basis including as a result of possible changes to the applicable legislation or orders issued by the Personal Data Protection Regulatory Authority. The modifications and updates to the Informative Statement will be applied and brought to the attention of data subjects as soon as adopted by means of the Site’s Privacy Policy link. As a consequence, all data subjects are invited to visit the site regularly in order to check the updated Informative Statement.

Data subjects, Data Controller and Data Processor in relation to the Processing of Personal Data

The “Data Subject” in the context of data processing is the natural individual to which the personal data refer.

The “Data Controller” in the context of data processing is the party with responsibility for taking decisions in relation to the purposes and procedures used in the processing of personal data together with the tools used, including the security profile, and is Italian Fable S.r.l., in the person of its Authorised Representative Dr Giovanni Loser, with its registered office in Trieste, post code 34123, at Via Economo 12/9 (Italy).

The “Data Processor”, in the context of data processing is responsible for such processing and is Italian Fable S.r.l., with its registered office in Trieste, post code 34123, at Via Economo 12/9 (Italy).

For responses to questions raised by the Data Subjects in the exercise of their rights set out in Article 7 of Legislative Decree 196/2003, they are invited to write to: Italian Fable S.r.l., at the e-mail or to the latter company’s registered office by means of registered letter with notice of receipt.

Data Processing purposes and procedures 

The personal data processed by IF are collected when provided directly by the Data Subject or automatically.
The personal data provided directly by the Data Subject will be all the personal data entered on the site on the “Purchase” page (to make an online purchase, to request information, to gain access to a service or for any other reason) or which are in any case provided to IF by any other procedure.

Such data will be processed for:

A. The purposes for which the processing of the customer’s data is required

The data provided and/or acquired from third parties during the contractual relationship will be processed by the Company for the following purposes connected to the performance of the contract including the pre-contractual stage, for the supply of the above services:

  • a) The provision of the service requested, that is, the management of the purchase orders and connected activities (for example: for communications on the state of the order, responses to requests for information, the sending of the products, etc.);
  • b) Management of the accounts of Data Subjects who register with the Site and the related services;
  • c) Activities of an administrative, accounting, legal and statistical kind;
  • d) Invoicing of the products and any supplementary services;
  • e) The management of any complaints and disputes;
  • f) Fraud prevention and the management of delays or non-payments;
  • g) Protection and possible recovery of monies owed either directly or through third parties (debt-recovery agencies/companies) to which the data necessary for such purposes will be communicated;
  • h) Assignment of the receivable to authorised companies;
  • i) Storage and use of accounting data relating to payment punctuality in relation to bonus policies and to refuse future contractual relationships;
  • j) The sending of communications by institutional authorities by reason of emergency orders.

Furthermore, the data, including those relating to information entered on the Site, may be used by the Company to enforce or defend its own rights in judicial proceedings. In such circumstances the data will be processed only for such purposes and in any case, only for the time strictly necessary for the achievement of the same.

In the case of the initiation and management of new or additional contracts, the Company will be able to process data on the state and punctuality of payments and possible complaints in the context of ongoing or completed contracts by referring to its archives for the purposes of preliminary checks;

The data provided will be processed by the Company either directly or through third parties not only for the purposes indicated above but also for possible access to the services of the site, including: checking the state of requests and/or reporting of faults and assistance.

In addition to the purposes set out above, personal data may also be processed to comply with obligations laid down by laws, regulations and Community legislation and by instructions from the sector supervisory authorities.

B. Additional purposes of the processing following the customer’s consent 

If Data Subjects give their consent at the moment of the activation of the requested service or they give it subsequently, and up to their revocation of such consent, the personal data may be processed by the Company including by automated means (e.g. by telephone, sms, mms, fax, electronic mail or web applications), for the communication of commercial information and direct sales, in relation to the products and services offered by the Company or its suppliers, market research and surveys.

In exception to the above, the postal address provided to us during the purchase of our products or services may be processed by the Company, save when opposed by the Data Subject in the manner explained in point C) belowfor the sending of market research and postal communications containing information and materials of an advertising, promotional or commercial nature relating to our products or services analogous to those purchased by the Data Subject.

In addition, if data subjects consent, the individual and detailed personal data may also be processed by the Company to identify specific consumption behaviours or habits, including by means of electronic processing, in order to improve the services provided, meet Data Subjects’ needs and send commercial proposals of interest.

The above is without prejudice to the Company’s right to process the above data in aggregated form in compliance with the measures laid down by the Privacy Regulatory Authority and by reason of the specific release from consent permitted by the latter Authority, for electronic analysis and processing (for example: the classification of our entire clientele in homogeneous categories on the basis of service, consumption, expenditure etc. levels) aimed at the periodical checking of the development and economic trends in the Company’s business with the consequential orientation of the related industrial and commercial processes, improvement of services and tariff plans and the design and implementation of commercial communication campaigns.

C. Additional purposes of the processing to receive advertising from third parties through the mandating company with the consent of the Customer.

If data subjects give their additional, specific consent at the moment of the activation of the requested service or give such consent subsequently, the personal data, including traffic data, may be processed by the Company to communicate and send, including by automated procedures (e.g. by telephone, sms, mms, fax, electronic mail and web applications), advertising materials and commercial information from third parties.
The release of the data and the consent for their use in the processing purposes under this point and point B) above, is discretionary but may help to improve our products and services and communicate developments of interest to customers.

Data Subjects will in any case be able to check and revoke possible consent provided for such purposes at any time, contacting the Company without charge at the e-mail address or sending a registered letter with notice of receipt to the following postal address: Italian Fable srl, Via Economo 12/9 –  34123 Trieste (Italy).

Following any refusal or revocation of such consent the Company will only process the data for the purposes described in point A) above.

Data collected automatically 

The data collected automatically will be in the form of navigation data and so-called “cookies”. The computer systems and the software procedures used for the functioning of the Site, will acquire, during their normal functioning, some personal data whose transmission is implicit in the use of Internet communication protocols, that is so-called “navigation data”.

This is information which is not generally collected to be associated with identified Data Subjects but which, by its nature might make it possible to identify the latter through processing and association with data held by third parties.

IP addresses or domain names of the computers used by users visiting the Site come within this category as do addresses in URI code (Uniform Resource Identifier) of the resources requested, the time of the request, the method used in submitting the request to the server, the dimension of the files obtained in response, the numerical code indicating the state of the response given by the server (successful conclusion, error etc.) together with other parameters relating to the data subjects’ operating system and IT environment.

These data will be processed to generated statistics on the use of the Site and check its correct functioning.

A “cookie” is a small file sent by the Site and memorised in the Data Subject’s browser while using an Internet site. Cookies may only be memorised for the time a particular site is used (session cookie) or for a longer time, independent of the session (persistent cookie).

The Site currently uses “technical cookies”, that is, those necessary for navigation in that they permit the correct use of the Site and its proper functioning. These include the cookies which allow the creation of a customised account, the enabling of a log-in, the display of contents in the pre-selected language on every visit, recognition of the country from which the user connects to the Site (remembering these settings on future visits), and the management of orders. The above cookies are strictly necessary for the functioning of the Site and their disabling could prejudice successful navigation of the same. This category also includes “analytical cookies” allowing the statistical analysis (through other IT systems) of site-users’ navigation for the sole purpose of understanding its use by the latter. These include, for example, the cookies which record the number of clicks effected on a page on the Site and the number of pages visited by data subjects. These analyses are carried out on anonymous data and have a purely statistical function. They are not indispensable for the functioning of the Site and are processed anonymously.

In order to achieve the purposes described above, or other purposes, cookies collect and record navigation information although the Data Subject is able to choose whether such cookies are used or not. As a consequence, if the data subject blocks or impedes the use of cookies, some Site functionality may be impeded, slowed down or in any case, rendered less efficient.

It is possible to modify the settings relating to cookies, including their enablement and disablement, by selecting the appropriate options on the user’s browser. Furthermore, more generally, following the selection of the appropriate settings, almost all computers are able to warn the Data Subject if a cookie has been sent or permit the total disabling of cookies. If they are completely disabled this may preclude the use of many functions together with the precise navigation or display of the Site or other web pages.

Personal data will be processed by automated electronic and online procedures and manually, for the time strictly necessary to achieve the purposes for which they have been collected. Specific security measures will be observed to avoid the loss of data, their unlawful or incorrect use and unauthorised access to the same.

Obligatory or discretionary nature of the provision of the data, and the consequences of a possible refusal to provide a response

The provision of data as provided for under point A) above, is obligatory for the purposes of the provision of the service requested by the Data Subject, that is, in the case of purchase orders and registration on the Site.
If the data subject refuses to respond, it will be impossible for the Data Controller to provide the service requested, for goods to be purchased online and to register with the Site.

As noted under points B) and C) above, the provision of data for other services with promotional, informative or research purposes (for example, to subscribe to the newsletter) is discretionary.

Extent of the communication, knowledge and dissemination of the data

The processing of the data provided by Data Subjects will normally be carried out at the Data Controller’s registered office by the Data Processor and processing staff, that is, by the employees, collaborators or shareholders of the Data Controller or possibly by temporary Data Processors and staff but only for operations involving the maintenance of the Site.
The personal data provided by Data Subjects submitting requests for purchases or information or who subscribe to the services offered by the Site (that is, informative or commercial services) will only be communicated to third parties in cases where this is necessary in order to provide the service requested (for example, companies providing postal service and couriers for the shipping of the materials).
To such end, some or all of the data may be communicated to: companies connected with Italian Fable S.r.l.; persons, companies or professional practices providing services of assistance and consultancy to Italian Fable S.r.l. in accounting, administrative, legal, tax and financial matters; parties whose right to have access to the data is recognised by legal provisions or court orders and third parties responsible for the Site’s technical functionality.

No personal data will be disseminated generally.

The Data Subjects’ Rights

The data subject will have the following rights pursuant to Article 7 of Legislative Decree 196 of 2003:

1) The Data Subject will have the right to obtain confirmation of the existence or otherwise of personal data regarding him, even if not yet recorded, and the communication of the same in intelligible form.

2) The Data Subject will have the right to obtain indications on the following:
a) The origin of the personal data;
b) The purpose and procedures used in the processing of the same;
c) The logic applied in the case of processing effected using electronic means;
d) The identifying details of the Data Controller, the Data Processors and the Designated Representative pursuant to Article 5, paragraph 2;
e) The parties or categories of parties to which the personal data may be communicated or which may come to know of the same in their capacity as designated representative within the territory of the state, Data Controller or Data Processor.

3) The Data Subject will have the right to require the following:
a) The updating, correction, or, where this is in his/her interests, supplementing of the data;
b) The deletion, conversion into anonymous form or blocking of any data processed in breach of the law, including those which do not have to be preserved in relation to the purposes for which the data were collected or subsequently processed;
c) Receipt of confirmation that the parties to whom the data have been communicated or disclosed have been informed of the operations referred to under letters a) and b) above, including with regard to their content, save in circumstances where such compliance is shown to be impossible or entails the use of resources manifestly disproportionate to the right to be protected.

4) The Data Subject will have the right to oppose, in whole or in part:
a) On legitimate grounds, the processing of the data concerning him even though pertinent to the purpose for which it was collected;
b) The processing of personal data regarding him/her for the purposes of the sending of advertising materials, direct sales, the conduct of market research or commercial communications.
